1. Introduction
This Cancellation and Refund Policy ("Policy") governs the terms and conditions applicable to cancellations and refunds for services offered by Claim It ("Company," "we," "us," or "our") through our mobile application and platform ("App"). By subscribing to our services or engaging with our offerings, you ("User," "Subscriber," "you," or "your") acknowledge that you have read, understood, and agree to be bound by this Policy.
This Policy should be read in conjunction with our Terms and Conditions and Privacy Policy available on our App.
2. Scope of Services
Claim It provides two distinct service models:
a) Annual Subscription Model: Comprehensive insurance claim assistance services including support for cashless claims, reimbursement claims, claim filing guidance, and related advisory services.
b) Rejected Claims Resolution Model: Specialized services for revival and settlement of rejected insurance claims through legal, technical, and administrative interventions.
3. Subscription Model – Cancellation and Refund Policy
3.1 Nature of Subscription
The Annual Subscription is a one-time payment for a period of twelve (12) months from the date of subscription activation. The subscription fee grants you access to all services offered under this model for the entire subscription period.
3.2 Non-Refundable Subscription Fee
The subscription fee is strictly non-refundable under all circumstances, including but not limited to non-utilization or partial utilization of services, change of mind, dissatisfaction with services, technical issues on the user's end, termination by the subscriber, or force majeure events.
3.3 No Carry Forward Provision
Any unused subscription benefits, services, or period shall not be carried forward to the next subscription cycle. Upon expiry of the subscription period, all entitlements shall stand terminated automatically.
3.4 Subscription Renewal
Subscribers wishing to continue services beyond the initial subscription period must purchase a fresh subscription. Previous subscription benefits cannot be transferred or adjusted.
3.5 Right to Modify or Discontinue Services
The Company reserves the right to modify, suspend, or discontinue any service or feature with prior notice of fifteen (15) days. Such changes shall not entitle subscribers to any refund.
4. Rejected Claims Resolution Model – Cancellation and Refund Policy
4.1 Initial Registration Fee Structure
Users must pay an Initial Registration Fee calculated as a percentage of the claim amount plus applicable GST at 18% before processing begins.
4.2 Non-Refundable Registration Fee
The Initial Registration Fee (including GST) is absolutely non-refundable under any circumstances including withdrawal, unsuccessful resolution, delays, incorrect information, non-cooperation, alternate resolution, or force majeure events.
4.3 Adjustment Against Final Bill
The Initial Registration Fee shall be adjusted against the final service charges upon successful resolution of the claim.
4.4 Mandatory Nature of Registration Fee
Payment of the registration fee is mandatory for initiating the claim resolution process.
4.5 No Guarantee of Success
Payment of the registration fee does not guarantee claim approval. Outcomes depend on insurer policies, underwriting, and regulatory factors.
4.6 Service Termination by User
If the user terminates services after payment, no refund shall be provided and the registration fee shall be forfeited.
5. Payment Terms and Conditions
5.1 Accepted Payment Methods
Payments are accepted via credit cards, debit cards, net banking, UPI, digital wallets, and other methods available on the App.
5.2 Payment Security
Payments are processed through secure, encrypted gateways. The Company does not store card details.
5.3 Payment Gateway Charges
Any gateway or transaction charges shall be borne by the user.
5.4 GST and Tax Compliance
Applicable taxes including GST shall be charged additionally and GST-compliant invoices will be provided.
5.5 Currency
All payments must be made in Indian Rupees (INR) only.
6. Cancellation Policy
6.1 Cancellation by User
Users may request cancellation through the App or via email to support@theinsurancebar.com, subject to non-refund provisions.
6.2 Cancellation by Company
The Company may cancel services due to breach of terms, fraudulent activity, abuse, non-payment, legal violations, or misuse of the platform.
6.3 Effect of Cancellation
Upon cancellation, access to services shall be terminated immediately with no refund.
7. General Provisions
7.1 Service Delivery Timeline
Delays due to factors beyond Company control shall not entitle the user to any refund.
7.2 User Obligations
Users must provide accurate information, submit documents timely, cooperate with the team, and maintain account confidentiality.
7.3 Intellectual Property
All intellectual property used during service delivery remains the exclusive property of Claim It.
7.4 Confidentiality
Both parties agree to maintain confidentiality subject to legal requirements.
7.5 Limitation of Liability
The Company's liability shall not exceed the fees paid for the specific service.
7.6 Dispute Resolution
Disputes shall be resolved through arbitration in Ahmedabad, India, under the Arbitration and Conciliation Act, 1996.
7.7 Jurisdiction
Courts in Ahmedabad, Gujarat shall have exclusive jurisdiction.
7.8 Severability
Invalid provisions shall not affect the remaining enforceable terms.
7.9 Amendments
The Company may modify this Policy at any time with notification.
8. Acknowledgment and Acceptance
By using the App, you confirm acceptance of this Policy and acknowledge that all fees are non-refundable.
9. Definitions
Definitions include Subscription Period, Registration Fee, Services, Successful Resolution, User/Subscriber, and Working Days as outlined in this Policy.
